The tribunal strike APC motion on Atiku qualification to contest Presidential election

The Presidential election petition tribunal has struck out APC motion seeking to disqualify Atiku Abubakar on the alleged ground that he is a Cameroonian by birth.

The tribunal held that APC can not rely on its reply to the petition filed by Atiku to challenge his qualification and that the party ought to have filed its own petition.

The tribunal also struck out the statement on oath made by former minister of Aviation Osita Chidoka on the ground that both his testimony and statement were fresh facts not contained in Atiku and PDP petition.

So far, the tribunal had ruled on all the preliminary objections to petition and dismissed almost all of them while some partially succeeded.

In effect several paragraphs of Atiku and PDP petition have been struck out particularly the paragraphs where petitioners accused police, army and some other persons of perpetuating crime during the election.

The tribunal said that those who were accused of serious crime in the petition were not made party to the petition, therefore in the interest of fair hearing it struck out the paragraphs were the accusations were made.

The members of the tribunal has just rised for a short break .When they resume, the tribunal will deliver its judgment on the main petition
