Court clears Andy Ubah, dismisses certificate forgery suit

An Abuja High Court has dismissed a suit filed against Dr Andy Ubah, a senator representing Anambra South over an alleged certificate forgery

A plaintiff, Uchenna Nnadi, had filed the suit, challenging Ubah’s West African Examinations Council (WAEC) certificate and his eligibility to hold public office.

Dismissing the suit on Friday, Justice Valentine Ashi held that Nnadi failed to prove that Uba’s certificate was forged.

The judge further held that the burden of proof was on the plaintiff, saying that it is instructive that the plaintiff has failed to provide any evidence of forgery.

According to the judge, Nnadi should have investigated and cross checked his facts with the Independent National Electoral Commission (INEC), which cleared Ubah as being eligible to hold any public office.

The judge added that Uba had been using the same certificate since 2007 without any alteration.

The judge further held that the election forms submitted to INEC for the elections in which Ubah had participated did not have any alteration.
