Herbal institute drags Abia ministry, others to court over land acquisition
An Umuahia High Court early this week, ordered that pre-trail notices be served to the 3rd (Ministry of Lands) and 4th (Ministry of justice) defendants respectively.
The High Court sitting in Umuahia and presided over by Justice C. E. Anyim, gave this order Tuesday and adjourned for pre-hearing till the 27th of June, 2017 in a suit filed by an indigenous herbal institute against the Abia State ministry of Lands and four others.
The trial Judge, Justice Anyim had adjourned the matter after hearing from both the Counsel to the Plaintiff, Godwin Oriaku and Counsel for the 1st Defendant, Uche Igwe.
Explaining further on the high court proceeding and adjournment, the counsel to the Plaintiff said that they were in court in respect in respect of a suit filed by one Wonderful Root Nigeria and Dr. Mrs. Uzondu, against one Veronica Uloma Onyebula and others, joining Abia state Ministries of Lands and Justice.
According to the Counsel, the subject matter is “the P13 plot that was allocated to Wonderful Herbal at IBB Phase 1 GRA Housing Estate in Umuahia for the building of Herbal institution.
The plaintiff counsel further disclosed, “We also filed a motion after serving them (Defendants) with the necessary documents and they were not forth coming.”
He maintained that the high court granted their prayer for the withdrawal of their earlier motion for default judgment against the defendants, ‘But when the 1st, and 5th defendants filled their respective statement of Defence on pre hearing information sheet, we withdrew against them in respect of the default judgment and asked that the matter be stepped down for pre hearing.”
Oriaku further stated that the presiding judge ordered that pre trail notices be served to the 3rd (Ministry of Lands) and 4th (Ministry of justice) defendants respectively.
