Alleged fraud: Failure ‎to serve Uwajeh with criminal summons stalls arraignment

Failure on the part of the federal government to personally serve Court summons on a self acclaimed private investigator from the United Kingdom Chief Victor Uwajeh stalled his arraignment before a federal high court in Abuja on Tuesday.

The federal government had filed a four count charge against Chief Victor Uwajeh before Justice John Tsoho of the federal high court Abuja over allegations bordering on fraud, ulttering false documents and forgery.

When the matter came up yesterday for arraignment prosecuting counsel, A K Alilu told the court that the office of the Attorney General of the federation was making efforts to serve the defendant with the criminal summoned filed before the Judge, Justice John Tsoho.

According to the prosecutor, the trial could not go on because Uwajeh has not been served with criminal summon personally as directed by the Judge.

He said that the effect of the service is to compel the defendant (Uwajeh) to appear in court personally for arraignment.

Meanwhile, the court has asked both the prosecuting and the defense counsels to return back to the court registrar today (Wednesday) for a shortest date for arraignment.

At the last adjourned date, the trial judge had ordered that self acclaimed private investigator Chief. Victor Uwajeh to appear before the court on the 13 February, 2018 (yesterday) to take his plea or face warrant of arrest.

The federal government had filed charges against the embattled Uwajeh for allegedly uttering false documents through fraudulent means against a serving senator representing Anambra south senatorial District, Senator Andy UBA with intent to commit fraud.

At the last sitting, Chief Victor Uwajeh was absent in court as well as today.

The court had fixed yesterdays date to enable the embattled Uwajeh take his plea.

Embattled Uwajeh had dragged Senator Andy Uba, to court over alleged refusal to pay the sum of £1.9 million debt.

Following police thorough investigations based on the petition Senator Uba wrote to the Inspector General of Police, IGP, Ibrahim Idris, the police investigations indicted him (Uwajeh).

Also in the suit, the plaintiff accused Senator Uba of being an impostor in relation to his academic credentials which the police investigation revealed that the information he provided was fraudulently obtained.

According to Uwajeh, in the suit, Senator Uba engaged his services for an assignment in United Kingdom Border Agency and in the United States of America.

The plaintiff said in order to make the work easier for him, Senator Uba gave him the data pages of both his American passport and Nigerian passport.

At the last proceedings before the federal government filed charges before a federal High court Abuja, presiding judge, Justice Sylvester Origi,said that the matter could not proceed as the plaintiff lawyer asked the court to adjourned the matter to enable all the parties settled out of court which senator UBA insisted that he is not disposed to the arrangement urging the court to do the needful.

The judge further adjourned the suit on the instance of the plaintiff (Uwajeh) for the outcome of the out of court settlement and report back to the court .
