Court adjourns Hon. Jibrin suit seeking to set aside suspension

The Federal High Court in Abuja on Friday adjourned indefinitely the suit filed by suspended member of the House of Representatives Hon Abdulmumin Jibrin seeking to set aside his suspension from the House.

Jibrin was suspended by his colleagues for going against the rules of the parliament last year .

Justice John Tsoho had adjourned the matter indefinitely when he heard that some members of the House that the court refused their applications to be joined as co- defendants have lodged appeal at the Supreme Court.

At the resumed hearing of the matter on Friday, lawyer to Jibrin, Mr Femi Falana (SAN) had argued that the appellant was not a party to suit and urged the court to proceed with the matter.

But the lawyer to the House drew the attention of the court to the pendency of an appeal before the Supreme Court and urged the court not to proceed with the case as according to him, that would set the lower court in collusion with the apex court .

In his ruling, Justice Tsoho held that since the information about the appeal on the matter at the Supreme Court had reached the court, the court will not continue with the case until the appeal is determined by the apex court.

The Daily Times recalls that Hon. Abdulmumin Jibrin had, in 2017, commenced Suit No: FHC/ABJ/CS/812/2016 to challenge his suspension from the House. But, Hon. Ossai Nicholas Ossai and Hon. Orker – Jev Emmanuel Yisa, who were mentioned in the suit had appealed against the court refusal to be joined as co-defendants on the grounds that the plaintiff’s complaint impugned their characters.
