Property owner petitions FCT minister over illegal demolition of property

Despite order of the High court of the Federal Capital Territory restraining officials of the Federal Capital Development Authority (FCDA) from invading the property of a firm, Obike Industry Limited, some officials of the FCDA yesterday moved in with their bulldozers demolishing part of the property.
Obike Industry Limited are owners and operators of the garden known as Peka garden and park located at No: 26, Aswan street, Wuse zone 3 Abuja.
Describing the demolition of the property as illegal and contemptuous,management of the firm wondered why FCDA officials will choose to go through the back door to illegally cause mayhem on a property that was legally accorded to them. .

Onyeka Ikenta has petitioned the FCT Minister, Mohammed Bello calling on his attention to the illegal demolition of his property.
The petition which was also addressed to the the FCT Permanent Secretary is asking the duo to call Murktar Galadinma who is also a director in the FCT to order.
The petitioners accused Galadinma of using illegal means to cause mayhem on him.
“Galadinma illegally led some members of the task force to demolished the property i legally acquired. They did so despite the court order being conspiciously placed on the wall.
” Our client and staff also called their attention to the court order. We therefore bring the foregoing contemptuous act of your office which constitute serious impunity to your attention for your immediate action and to call all respective persons to order” it stated.
Daily Times recalls that Justice Peter Kekemeke of the High court of the Federal Capital Territory sitting in Apo had stopped the FCDA officials from invading the property.
The ‎firm had approached the court for an order to restrain the FCDA from taking over or demolishing their property.
‎In the ruling of the court in motion no FCT/HC/M/2655/15, the court held, ” An order of interlocutory injunctions hereby issued restraining the 1st, 2nd,3rd and ‎5th defendants, their privies, heirs, representatives, assign, agents, officials, staff, workmen, forcemen
or whatever name called from taking possession of developing, erecting, constructing or building any structure or changing the topography of or in any way disturbing, dealing, interfering or tampering with or continuing any of he above action on Plot 1353 Cadastral Zone A02 Wusse 1,Abuja, pending the determination of the substantive suit”.
