Nyako's Impeachment: Court Passes Verdict May 22

A Federal High Court, sitting in Yola, on Monday, has set May 22, 2015, to rule on the forceful removal from office of former governor Murtala Nyako, who is challenging the move by the Adamawa State House of Assembly.

The presiding judge, Justice Bilkisu B. Aliyu, after adopting written addresses of the parties to the case and their arguments,announced that the case be adjourned.

At the resumed sitting of the case in Yola, counsel to former

Nyako, Mr. OgunyeleOlukoya, in his final submissionprayed the court to quash the removal ofNyako, since the case did not follow a proper procedure.

He argued that the applicant’s complaint in the case bordered on theviolation of his right to fair hearing guaranteed him under Section 36 of the 1999 Constitution as amended.

Olukoya impressed it on Aliyu to serve the cause of justice, and cited many cases, where he noted that the applicant’s plea for rightsto fair hearing was breached and the courts boldly ruled, in thosecircumstances, in favour of the applicant, adding that, in this case, doing so would not make the heavens to fall.

However, counsel to the Adamawa State House of Assembly, Mr. Leonard Nzadon, urged for the judge to rule in his favour, as he observed that the plea was “grossly insufficient.”
