N1bn judgement debt enforcement: Court hears ex deputy Gov Simon application Feb10

 

 

The National Industrial Court of Nigeria,(NICN), sitting in Abuja on Wednesday shifted the application seeking to enforce N1,070,860,138 judgement debt in favour of former Deputy Governor of Kogi State, Elder Achuba Simon to February 10, 2026.

The matter which was earlier scheduled for hearing on Wednesday January 14 , was adjourned by Justice R.B.Haastrup to allow the judgement debtor respond to the former Deputy Governor application seeking an Court order to attach properties belongings to the United Bank For Africa PLC who had refused to release garnisheed Kogi State fund found in its custody.

When the matter came up for hearing on January 14 , 2026 before the Court the judgement debtor counsel informed the court that he was served with counter affidavits yesterday morning in response to his preliminary objection and another application which he served on them on Tuesday.

The counsel said that he needed time to respond to judgement Creditor counter affidavits, therefore asked the Court to grant an adjournment.

Responding, the judgement Creditor counsel Femi Falana, SAN, objected to adjournment noting that the judgement debtor was served with application last year but decided to hold back their response until Friday last week.

He said that despite the delay caused by judgement Debtor, they responded to the preliminary objection and had expected them to demonstrate some level of commitment toward resolving the issue.

Recall that the United Bank For Africa PLC a Garnishee in an appeal marked CA/ABJ/PRE/ROA/CI/630M1/2025 between the Governor of Kogi State, the Attorney General of Kogi State & Commissioner for Justice and Elder Achuba Simon had refused to comply with the Court of Appeal order directing it to pay the Garnisheed sums to Elder Achuba Simon .

UBA insisted will not comply with the court orders even though the bank had earlier during the Garnishee proceedings accepted in a deposition that it has the money in the account of Kogi State with it.

In an effort to enforce the Garnishee Order Absolute made on 27th November 2025 , Simon had specifically, asked for a leave of the court to issue a writ of execution attaching the property of the Garnishee situated at No 11 Lafia close, Area 8, Garki, Abuja and NO 18 Ademola Adetokunbo Wuse , 3 FCT Abuja .
