Ex CJN Onnoghen: Exparte order sacking CJN Onnoghen breaches his right to fair hearing , says Court Appeal

Court of the Appeal sitting in Abuja said on Friday that the ex-parte order issued by Code of Conduct Tribunal on 23 January sacking the former Chief Justice of Nigeria CJN Walter Onnoghen breached his right to fair hearing.

The Court of Appeal stated this in unanimous judgment on the interlocutory appeal filed by Onnoghen.

The Court of Appeal also held that tribunal was in error for disobeying the orders of Federal High Courts ,FCT High Court and National Industrial Court.

However , the Court of Appeal said that the interlocutory appeals have been spent by the fact that the Code of Conduct Tribunal has delivered its final judgment.
