Court judgment on Bagudu: Victory for Kebbi, Nigeria, says APC Chairman

Chairman of All Progressives Congress (APC), in Kebbi State, Architect Bala Sani Kangiwa, has said that the dismissal of a suit filed against the election of Kebbi State Governor, Abubakar Atiku Bagudu, by a Federal High Court Abuja, is a victory for the state and Nigeria at large.

Kangiwa, stated this in an interview with Daily Times shortly after the Judgment last week Friday, pointing out that “I am highly elated that at last the court has cleared our Governor.”

It would be recalled that a plaintiff, Mr. Anthony Itanyi, in the suit asked the court to nullify the election of Governor Bagudu of the APC for lying under oath in the form he submitted to Independent National Electoral Commission (INEC), prior to 2015 governorship election in the state.

Itanyi, in suit number FHC/ABJ/CS312/2015 asked the presiding judge, Justice Mohammed Ahmed to invalidate the election that brought Governor Bagudu to power and confirm Major General Bello Yaki (Rtd), Peoples Democratic Party (PDP) gubernatorial candidate in the election as the winner and subsequently order INEC, a co-defendant to issue him certificate of return.

Bagudu, had earlier filed a preliminary objection challenging the jurisdiction of Federal High Court to entertain the matter.

The matter was appealed to Supreme Court and the apex court subsequently ruled that the Federal High Court has jurisdiction to hear the case, besides ordering for an accelerated hearing on the matter.
