Court hears Pinnacle’s N1bn suit against ICPC Nov. 6

The Federal High Court sitting in Abuja has fixed hearing of the suit filed by Pinnacle Communications Limited against the Independent Corrupt Practices and other related offences Commission (ICPC) for November 6.

The company in the suit marked FHC/ABJ/CS/779/18 is praying the court for an order directing the ICPC to pay it N1billion as damages for unlawfully withholding its money domiciled in Zenith Bank without a valid court order.

The matter which was slated for hearing on Tuesday could not hold due to the absence of the judge, Justice Taiwo Taiwo, who was said to be away for an official assignment.

To be specific, Pinnacle Communications is seeking for an order for the payment of N1billion as general, exemplary and punitive damages against the defendants for their unlawful and illegal act.

It also wants a declaration that the act of the first defendant (ICPC) in ordering the second defendant (Zenith Bank) to place a post-no-debit restriction on the plaintiff’s account without any court order is ultra- vires, unlawful, injurious, unconstitutional and a breach of the plaintiff’s right to its movable property.

Also, the plaintiff wants a declaration that the failure of the third defendant to right the wrongful act of the first defendant in ordering a post no debit restriction on the plaintiff’s account is unlawful, illegal, unconstitutional and a breach of the plaintiff’s right to its movable property.

It equally, seeks an order of perpetual injunction restraining the defendants from placing any restriction on the plaintiff’s account with the second defendant without a valid and competent court order.

Lastly, an order of perpetual injunction restraining the first defendant from placing any form of restriction on the plaintiff’s account with the second defendant and or any other bank or financial institution in which the plaintiff maintains any account and or dealings, without a court order.
