Justice Nnamdi Dimgba of Federal High Court in Abuja, has fixed August 28th, to hear the suit challenging the move by First Bank Plc to takeover White Plains British School Limited.
Justice Nnamdi Dimgba fixed the date after listening to arguments by the school’s lawyer, Chukwu Machukwu-Ume (SAN) and the bank’s lawyer and the appointed receiver, Bola Olotu.
First Bank PLC sealed the school’s premises over a N619 million loan in June after another Federal High Court in suit no: FHC/ABJ/CS/1023/2015 granting it access to the school’s property.
But the school is challenging the Tripartite Legal Mortgage tendered and relied on by the bank and purported to have been made with the school and the former owners of the school’s land, France Lee Nigeria Ltd as forged.
