Appeal Court reinstates Sen. Ubah, dismisses high court ruling

The Court of Appeal, Abuja Division on Thursday reinstated Senator Ifeanyi Ubah as the duly elected senator representing Anambra South Senatorial District in the Senate.

The appellate court therefore, set aside the judgment of the Federal Capital Territory High Court which sacked Sen. Ubah, declaring it as a nullity.

In a unanimous judgment, the three-man panel of the court nullified the judgment of Justice Bello Kawu of the FCT High Court for being a judgement that emanated from an incompetent process.
Justice Kawu had in his judgment delivered on February 11, sacked Sen. Ubah on the ground that he was not qualified to have contested the February 2019 general elections.
However, the court of appeal said that the lower court lacks territorial jurisdiction to have entertained the suit in the first place and further held that it also lacks jurisdiction to have heard a suit that originated from an incompetent originating summons that was not signed by a lawyer or the plaintiff
