Bauchi govt to appeal judgment acquitting civil servant of misappropriating N8m

The Bauchi state government said it was set to file a notice of appeal against court judgment that acquitted and discharged one, Kabiru Ahmed, a civil servant who was alleged to be involved in the embezzlement of eight million naira (N8m) million realized from sales of plate numbers.

The accused, Ahmed Kabiru, a staff of Bauchi Internal Revenue Board (BIRS) in charge of sale of vehicles plate numbers was dragged before High Court number 8 for allegedly misappropriating N8 million, a proceed realised from sales of vehicles plate numbers.

In his judgment, the presiding judge, Justice Muazu Abubakar on Tuesday October 25, 2017 ruled that the accused, Kabiru has no case to answer as submitted, thereby ruling in favour of the accused, acquitting and discharging him.

The prosecuting counsel to the state Barrister Haruna Ibrahim said Kabiru was a staff of (BIRS) entrusted with motor plates number money worth millions of Naira.

He said “the Board set up a committee to investigate how monies realized from sales of vehicles plate numbers were remitted in the banks but he (Kabiru) was found wanting for not remitting over 8 Million naira to the Bank from the sales.”

So a case was filed against him under two count charge for allegedly embezzlement of public funds to the tune of N8million.

Barrister Haruna said “we are not satisfied with the judgment, we will file a notice of appeal that will transmit to the court of Appeal Jos, with all the witnesses we see whether he has a case or not.”

In his response the counsel to the accused, Barrister Ben Ogbuche, said the complaints have no reason to go for appeal because they have lost.
